The Office of the General Counsel is a diverse and dynamic organization within our firm, headed up by the General Counsel, with approximately 18 lawyers plus approximately 4 practice protection senior managers and managers within KPMG China. The Legal Department provides comprehensive legal services and broad risk management support to our firm’s leadership, functions and support staff.

This position will be based in either Beijing or Shanghai and will focus on employment matters for KPMG in China, Hong Kong and Macau. The individual will work closely with the General Counsel as well as other lawyers on that team and in the department, and will be expected to liase with a number of individuals within the Firm (e.g., Partner HR, Partner in Quality Risk & Management, HR managers, and other professionals, office and functional leadership, local administrative leaders), as well as outside counsel in China, Hong Kong and Macau.

Responsibilities

This position encompasses a diverse range of responsibilities in China, Hong Kong and Macau, including:

- Providing counsel on local employment law issues, discrimination and harassment allegations, and terminations (including role eliminations and reductions in force)

- Developing and reviewing template offer letters, as well as employment contracts for offices in China, Hong Kong and Macau

- Participating in the development, implementation and interpretation of Firm strategy and policy on a variety of People-related subjects, across all groups of Firm members (e.g., Partners, client-serving staff, knowledge professionals, and administrative support)

- Managing the firm’s involvement in actual or potential employment litigation; advising and supporting internal personnel investigations

- Advising the Firm’s strategic inorganic growth and Technology Quality & Risk Management (TQRM) groups; providing support on People-related dimensions of transactions and partnerships with third parties

- Advising on People-related issues relating to the Firm’s organic growth initiatives, including office openings, and launches of new practices and Solutions

- Advising Partner stakeholders and leaders of diversity & inclusion and recruiting functions

- Advising on non-compete and similar agreements to which our experienced hires may be subject

- Drafting and negotiating agreements with independent contractors, and working with HR colleagues on various issues including appropriate classification of third party service providers

- Managing and working with the firm's outside employment counsel globally

Ideal candidate

- Minimum 10 years’ experience with top law firm or multi-national corporations

- Solid knowledge and experience on labour arbitration practice in mainland China is necessary

- Top academic credentials

- Speaks and writes Fluent English and Mandarin Chinese

- Excellent written and oral communications skills

- Confident team player who is highly collaborative and flexible
