Position: 法律顾问/legal counsel

Job description:

§ To provide timely, pro-active and practical legal advice to all GiantKONE operations in China, including but not limited to all branch offices, manufacturing facilities, sourcing unit, research & development center, and major projects unit.

§ To review, draft and negotiate a broad range of business documents that arise from the day to day operations of the business throughout China.

§ To work with other GiantKONE functions and units in respect of legal aspects arising out of:

§ defending GiantKONE’s patents and other intellectual property rights against infringing parties in China;

§ mergers and acquisitions in China;

§ GiantKONE’s Chinese export and import business.

§ To localize, introduce, implement and coordinate existing global policies and guidelines with respect to legal and related matters (trademarks, code of conduct, major projects, mergers and acquisitions, competition etc.) and to contribute to the further development of the same.

§ To manage claims, disputes, mediations, litigation and arbitrations.

§ To ensure overall understanding to the most updated regulations, policies and laws concerning PRC business environment.

§ To train internal staff on company practices, relevant regulatory/compliance requirements and general legal and risk management issues.

Requirements:

：

§ Good hands-on knowledge of the full spectrum of legal practice with solid experience in contractual matters being a must. Experience in dispute resolutions, M&A and project/construction contracts is an advantage.

§ A good understanding of the multinational organization in China and the ability to work harmoniously and effectively across nation and cultural boundaries.

§ Having the ability to work in a multidimensional matrix organization and willingness to be a team player and the ability to earn the trust of his/her colleagues.

§ Able to deliver presentations with enthusiasm and energy and effectively organize ideas for logical presentation and acceptance.

§ Strong problem-solving, decision-making and risk assessment capabilities, with good judgment and commitment to delivering results.

§ A generalist in legal practice.

§ Must be a good communicator with good interpersonal skills.

§ Able to work independently and is not afraid of taking initiative.

§ Over 6 years experience in the legal related area in MNCs, Chinese or international law firms.

§ Minimum a Bachelor’s Degree in law.

§ Fluency in written and spoken Mandarin and English.

Ability to travel throughout China.
