Major Responsibilities:

 

Main area of practice is contract law - reviewing, drafting and negotiating complex commercial contracts (including, but not limited to, international and domestic OEM equipment supply agreements, site service contracts, spare parts agreements, procurement contracts; agency and distributor agreements);

Secondary area is provision of general legal advice across other practice areas including property law competition and consumer law and intellectual property

Working closely with internal business units, including sales, project management; procurement, operations, shared services (tax, HR, finance, compliance) to meet their required time frames and ensure compliance with the Global Commercial Considerations of Contracting risk framework

Assisting management to make informed decisions by providing practical and commercial solutions to project risks to protect the interests of FLSmidth

Acting as Regional Compliance Representative for China supporting the Global Compliance team by by conducting training, agent due diligence, and internal investigations. On the job training will be provided for this component of the role

Developing and maintaining template documents

Provision of internal advice and training to the businessBriefing and liaising with external legal counsel as required The position may involve domestic and international travel.

· 4+ post qualified experience obtain from an in house environment (highly preferred) or commercial division of a well regarded law firm

· holding a Law Degree from a reputable Chinese university and PRC Bar licence

· Demonstrated experience in the commercial contracting practice areas

· Demonstrated ability to communicate effectively in a consultative capacity, both verbally and in writing, with a broad range of people in both English and Mandarin

· Strong attention to detail and drafting skills

· Ability to work independently with minimum supervision while being able to contribute successfully to cross-functional teams

· Excellent organizational skills, ability to manage multiple projects, set priorities, follow through and meet deadlines

· Commitment to the provision of quality client service

· Commitment to continuing professional development

   

· Exposure to the cement, mining resources, manufacturing or construction industry

· Exposure to complex commercial/construction contracts

· Pragmatic approach to problem-solving, with emerging understanding of risk assessment and risk mitigation strategies

· Experience in providing specialized legal advice to various personnel in the organization hierarchy and with external agencies

· Experience in compliance, property and intellectual property law
