Position is responsible for leading the execution of Donaldson’s Global Ethics and Compliance program in the Asia Pacific (APAC) region including advising business leaders to influence strategic direction that supports ethical leadership, promotes ethical behavior, facilitates proper decision-making and provides the team with the tools and resources to advance ethical business practices.  Models and acts in accordance with Donaldson Values.

    

This person reports to Donaldson’s Director of Global Ethics and Compliance.

    

The successful candidate will be expected to develop a close working relationship with management teams located in the region and to be viewed as a trusted, valued business partner.  The candidate will also be expected to liaise with Compliance, Legal, Human Resources, Finance and Audit teams regionally and to some extent globally.

    

    

Responsibilities

• Supports the Director of Global Ethics and Compliance in relation to the design of the company’s ethics and compliance program, its controls and the framework for monitoring of program execution.  Advises on regional-specific requirements and perspectives.
• Contributes to periodic ethics and compliance reporting to senior management and supports continuous improvement of the compliance program.
• Advises management and business partners on our Code of Conduct, related policies and the implementation and operation of the compliance program.
• Influences management to take ownership for integrating ethics and compliance into their organization while leading by example.  Coach and educate business partners in matters of ethics and compliance.
• Drives personal accountability for ethical decision-making through the use and promotion of ethical models, processes and tools.
• Understands the regional APAC business strategies and how they may impact the overall risk profile of the enterprise.
• Advises the organization on management of specific risk areas including anti-corruption and anti-bribery and conflict of interest.
• Intakes, consistent with established processes, reports of actual or potential Business Conduct (compliance) concerns.  Be viewed by employees as a resource for them to report concerns.
• Coordinates and conducts investigations of alleged violations of Donaldson Code of Conduct and its policies, laws and regulations.  Objective, discreet, process-oriented, thoughtful
• Consults with regional and corporate legal personnel and human resources as necessary.
• Maintains documentation of compliance activities including investigation case management.
• Assists in the due diligence of third parties and M&A targets including the identification and remediation of risk and red flags.
• Conducts ethics and compliance risk assessments.
• Provides ethics and compliance related awareness and training on our Code of Conduct and related policies to employees as well as third parties.

                                                            

    

Experience/Qualifications

• Bachelor’s degree is required. Other advanced or Law degree is beneficial but not required.
• 5-7 years of relevant compliance/legal/investigations/risk management experience in a multi-national organization.
• Certified Compliance and Ethics Professional (CCEP) or similar certification is beneficial but not required.
• Ability to understand compliance/legal material and recognize critical issues.
• Ability to apply knowledge of multi-disciplinary business principles and practices to achieve successful outcomes.
• Positioned to make independent judgements but also knows when to consult with others.
• Strong organizational skills and the ability to work independently.
• Work in an environment of extremely high levels of confidentiality.
• Demonstrated ability to work effectively with business partners at all levels through the organization.
• Ability to influence actions, decisions and to drive change.
• Excellent written, verbal communication and presentation skills.
• Microsoft Office (Word, Excel, PowerPoint) proficiency.
• Mandarin and English language proficiency

                                                        

    

Physical/Travel

• Position is based in Shanghai, China
• Regular and, at times, unpredictable travel, including international travel, is required.  Ability to travel (obtain visa as necessary to U.S., Singapore, Japan, Thailand, Indonesia, Australia, Republic of Korea, Vietnam, Malaysia, India).  Up to 30 percent travel.
• Participates in occasional conference calls outside of normal business hours.
