This position in Shanghai for experienced commercial lawyer with US-based multinational specializing in payments processing. The payments industry is extremely dynamic and specialized. We are looking for a Chinese-qualified lawyer with a solid commercial background who has substantial experience drafting and negotiating commercial agreements. Experience in payments would be helpful, but is not necessary. If you are a mid-level or senior associate (5+ years) in the corporate, commercial or finance practice of an international law firm in China, and if you are open to learning about a new industry, then this position could be for you. Ability to communicate well in English required. Ability to draft agreements in English preferred
DUTIES & RESPONSIBILITIES: (List specific action statements to describe the fundamental duties and responsibilities of the job.)
Responsibilities:
% of Time Spent
1. Draft and negotiate complex legal documentation in Chinese and basic legal documentation in English. Typical documents include term sheets, including letters of intent, processing agreements and other customer agreements, software licensing and maintenance agreements, joint venture agreements, and technology purchase agreements
2. Manage and oversee litigation
3. Provide guidance and training to the business on legal matters.
4. Advise our Chinese business on regulatory issues both in respect of the regulation of our customer business and the day to day operations of our subsidiary in China.
5. Collaborate and communicate in English with legal colleagues and supervisor outside of China.
6. The preferred candidate would also be able to provide transactional support for cross-border transactions outside of China
REQUIREMENTS:
1.Education: (Level and Major of Education)
- Law degree from a well regarded University in China
- Preferably with overseas education or qualification
2.Working Experience: (Minimum experience required in a particular industry, type of organization , functional area)
- Qualified to practice law in China for a minimum of 5 years
- Commercial/transaction experience working in various capacity in foreign companies or law firms (domestic or international) preferred
- Approachability and experience in dealing directly with business clients at all levels, whether gained in-house or in commercial private practice
- Experience working in the payment industry is a big plus
- Relevant work experience outside of South Korea, preferably in UK, US, or Australia is a big plus
3. Skill & Competency: (Such as personalities, leadership, teamwork, communication etc.):
- Desire and ability to learn and understand the core business about payment industry
- Ability to work independently, think commercially and make both practical and timely decisions.
- A solid work ethic, desire and ability to take initiative and responsibility
- Ability to handle and prioritize multiple projects, and work effectively in a fast-paced, results oriented environment.
- Good command of English and Chinese skills
