Kind of searches
? Awareness searches / alerts / “Signposts”
? Statistical searches, competitor analysis - Patent mapping
? Portfolio analysis
? Prior art searches, Novelty/Inventive step searches
? Strength analysis / validity
? Opposition searches to find anticipating documents in patent/non-patent literature
? Freedom-to-operate / Infringement searches
Support in IP-activities
Perform comprehensive, confident and responsive patent, non-patent and legal status literature searches in support of IP-activities (freedom-to-operate and infringement analysis, patentability, state-of-art, awareness, pre-patent filing reviews) of patent attorneys, internal business clients and inventors. The following activities are of importance:
? Search strategies:
o Interpret requests, design strategies for retrieval using different coding systems, analysis and evaluation and reporting of information from a variety of information sources
? Awareness:
o Develop, implement, monitor and update of alerts on patent applications of specific projects or competitive products, their application field and production processes.
o Help control the flood of information by selecting, analyzing, interpreting and making conclusions out of the most relevant and useful content.
o Use of information (re)sources in most strategic and cost-effective way.
o Develop and maintain end-user accessible electronic databases
o Maintain up-to-date knowledge of current patent issues, searching resources and techniques.
o Competitors/technology tracking
? Novelty:
o Identify novelty and inventiveness of new inventions
o Critical evaluation, studying and analyzing patents, scientific and technical documents and information as to competitor products (e.g. product brochures)
o Discuss content of ideas, processes with patent attorneys and inventors
o Discuss search results with patent attorneys and inventors
o Assist in identification of potentially patentable subject matter.
? Opposition-validity:
o Prepare patent claims charts, identifying processes, features.
o Deliver novelty and/or inventiveness destroying (anticipating) literature for eliminating competitor granted patents.
o Monitor threatening patent(application)s.
? Third party rights
o Monitor new patent applications and threatening patent(application)s of third parties
o Follow-up of patent watches and patent families including legal status actions
? Freedom-to-operate:
o Assist in advising on infringement and enforcement of patent rights.
o In depth/fit to the purpose patent search to protect DSM’ patent rights, intended sale of continued sale of products and services.
o Prevent infringement by DSM regarding known third party patents
o Goal is not to have unknown third party patents
? Statistical analysis – patent mapping:
o Patent landscaping – interactive analysis and visualisation of patent information.
o Discover technology trends, patterns and relationships.
o Evaluation of competitor’s R&D efforts, competitor intelligence.
o Reduce mass volumes of information to highly structured and/or graphical understandable info.
? Assist in specialized studies:
o SSD, BSD, BTA, IP-strategy
Reports:
? Report progress and results of all kind in electronic or paper form of searches to appropriate IP-attorneys, business, marketing and application managers, inventors, researchers.
? Portfolio overviews for customers
? Other reports on requests
Knowledge:
? Transfer of knowledge.
? Advanced understanding of intellectual property and patent law. Keeping up to date with changes in the IP-field.
? Theoretical and practical knowledge of novelty, inventiveness (problem/solution approach) for patentability issues important by Prior art searches, Novelty/Inventive step searches, Opposition searches and Strength analysis / validity searches
? Theoretical and practical knowledge of infringement.
? Detailed knowledge of patenting process.
? Understand the technical nature of inventions – interpret the technical and legal language.
? Proficiency in preparing and reviewing claim charts.
? Knowledge of foreign languages (English, and if relevant Chinese, German, French). Ability to use foreign databases (e.g. Japan, China, Korea, Latin America)
Report and verbal communication in English.
? Extensive knowledge of technical and legal online and web based patent and literature sources including different command languages (STN, Questel, Dialog, STN Anavist, Thomson Data Analyzer, Patbase, Delphion, Epoline, Espacenet, DPMA, USPTO, Japan IPDL, Korea Kipris, China SIPO, other homepages of different national patent offices,….)
? Detailed knowledge of different classification systems (polymer and fragmentation codes, Manual codes, IPC, ECLA, US-class, F-terms, IFI terms, structure searching, registry and DCR numbers)
? Applicable knowledge of statistical analysis and patent mapping tools.
? Broadening knowledge by means of courses.
? Knowledge of the diverse in-house search systems and query-tools.
? Knowing internal procedures.
? Ensure expertise in relevant technology
