Experience: A minimum of 6 years of experience working in a multinational company and/or an
international law firm. Exposure to the medical devices/healthcare industry in the Greater China
Region is preferred but not essential. Fluency in Mandarin and English is required.

TITLE: China Legal Counsel
Operating out of Align Technology’s Shanghai office, the China Legal Counsel will have oversight of
the legal and regulatory aspects of the activities of Align in the Greater China Region. The ideal
candidate will possess expertise in the medical device environment as well as intellectual flexibility
and versatility, solid business acumen and judgment, and thoughtful, sensitive and persuasive
interpersonal skills.
The China Legal Counsel will have a broad‐based, mission critical position encompassing the
following areas in Greater China: marketing and sales support and compliance with medical
advertising laws, compliance with anti‐bribery laws and codes, trademark enforcement and brand
protection, and general contract support.
This position is also responsible for providing practical, timely and high quality legal services for the
Greater China Region in the area of compliance, which covers a broad spectrum of support to Align’s
Marketing, Sales, Finance, Regulatory, Clinical, and Commercial teams. In particular, this position
will provide legal advice for compliance with the intricate laws, regulations and codes which apply to
medical devices in the field of advertising, promotion, and labeling of Class II medical devices as
permitted by the US Food and Drug Administration, rules and regulations applicable to the Greater
China Region, and Company policy.
This appointment represents Align Technology’s first in‐house lawyer to be hired in China.
QUALIFICATIONS & SKILLS
？ Top academic credentials from a leading Chinese university and preferably, completion of an
LL.M or J.D. at a recognized U.S. law school.
？ Admitted (in good standing) to practice law in the PRC.
？ At least 6 years’ work experience with an international law firm or equivalent in‐house
experience or a combination of the two.

？ Experience within the medical device sector or wider pharmaceutical, biotechnology or life
sciences sectors preferred.
？ Substantial responsibility in various areas of law and/or business in China, especially
commercial and business activity.
？ Experience with international trademark enforcement, prosecution matters, and brand
protection issues is preferred.
？ Intellectual flexibility and versatility, solid business acumen and judgment, and thoughtful,
sensitive and persuasive interpersonal skills.
？ Understanding of different cultural sensitivities represented in different legal systems, is
flexible and willing to learn and adapt to a continuously changing legal environment.
？ Ability to independently make sound judgments and recommendations on a wide variety of
compliance and ethical matters.
？ Excellent verbal and written communication skills and ability to communicate effectively
with a broad audience including medical, legal and highly specialized technical individuals.
？ Confident and approachable individual with a sense of humour and strong people skills.
？ Demonstrable ability to think and act independently.
？ Strong presentation and negotiation skills required.
？ Must be resilient, agile, fast moving, strategic and team oriented.
？ Possess fluent or native Mandarin and fluent English, together with excellent drafting skills
