Job Description JOB PURPOSE

To procure, manage and enforce patent and related intellectual property (IP) rights within Beijing Novartis Pharmaceutical Co., Ltd and for other Pharma-affiliated entities.

RESPONSIBILITIES

? Support the Global Pharma Patent department by advising and working with the globally responsible patent attorneys and outside agents in drafting, filing and prosecuting Chinese patent applications, by reviewing translation in PCT China national phase, and by assisting in formality procedures before the China Patent Office
? Support the local litigation team in administrative appeal and invalidation/opposition proceedings and enforcement actions in close interaction with the Global team
? Advise China Pharma business on IP matters, such as patent and regulatory exclusivity situations, for our own and competitor products, including the performance of patent validity analyses and freedom to operate clearances. and on general IP issues such as transaction and patent law compliance issues
? Provide IP support to the Business Development and Licensing team, including IP evaluation of transaction opportunities, evaluation of in-licensing opportunities, negotiation support, and contract drafting during active transactions
? Track and communicate legal developments in the IP area to the local and global Pharma Organizations
? Conduct patent/IP trainings in order to maintain a high level of patent/IP awareness throughout CPOs
? Maximize effective communication with local business and leadership team and the global IP attorneys
? Coordinate with corresponding Group IP/NIBR/V&D/Sandoz/Alcon attorneys
? Continue professional development and contribute to development of China and Global IP colleagues

Minimum requirements QUALIFICATIONS & CAPABILITIES

? Good understanding of the scientific, technical, legal, administrative regulatory and commercial aspects of pharmaceutical business
? Scientific background in pharmaceutical, chemistry and/or biological sciences
? In-depth knowledge of Chinese patent law, and preferably also of Chinese trademark law, unfair competition law and copyright law
? Detailed understanding of global patent systems (including but not limited to US, EP, JP and international systems), patent process, documentation and national and international patent office filing systems
? Effective presentation and communication skills
? Well-developed analytical and critical thinking skills, and sound decision-making abilities, with attention to detail to produce consistently accurate work
? Demonstrated ability to work independently as well as collaboratively in a team
? A considerable degree of flexibility and the capability of setting priorities to handle numerous cases simultaneously
? Strong customer-service focus to build and sustain good working partnerships with key stakeholders, local clients, global patent attorneys and outside counsel
? Strong organization and time management skills with flexibility, creativity, resourcefulness to successfully prioritize and manage multiple, competing priorities simultaneously.
? Interpersonal skills (partnership, influence/persuasion, teamwork)


EDUCATION / EXPERIENCE

Minimum Education: B.A., B.Sc. (or equivalent) in pharmaceutical, chemical or biological sciences, AND Registered to practice before Chinese patent office or at least 4 years of work as Patent Examiner at SIPO

Desirable Education: M.S., Ph.D. or equivalent in pharmaceutical, chemical or biological sciences

Languages: English and Mandarin Chinese written & spoken (required)

Ideal Experience: > 3 years working experience as a qualified patent attorney in MNC or a patent agent in a patent/law firm directly facing MNC clients, preferably practiced within the Pharma/Biotech Industry
