Summary of Job Duties and Responsibility
Administer contracts and variation orders including managing risk of contractual obligations relating to projects and oversee quantity surveying function to ensure completion of work, as well as project closure in relation Construction/Project Works.
Primary Duties and Responsibilities:
- Overall responsible for Sales Contract Terms & Conditions to minimize any commercial risk exposed on the company
- Assist commercial negotiation for pre-Sales
- Overall responsible for adequate proceeding on Sales Order Change and Cancellation
- Overall responsible for building a robust and reliable filing mechanism to ensure Contract and relevant execution documentation is centralized managed
- Overall responsible for trade compliance implementation throughout company
- Develop and maintain reliable contract review working procedure to ensure effective and efficient support for contract negotiation and booking
- Review tender documents, check and verify letter of Award and contract documentation prior to acceptance.
- Prepare contractual claims including extensions of time, prolongation cost, acceleration cost, and all other contractual claims.
- Constant working with Legal and Third Party Management to ensure effective commercial agreement works
- Daily contract desk review, and make sure that Tyco guidelines, rules and DOA are properly applied
- Lead the contract filing management throughout company
- Establish effective Backlog Management , covering Contract Change and Contract Cancellation Procedure
- Validate Sales Contract Cancellation application
- Spearhead the efforts when dealing with Legal dispute arises
- Establish effective Trade Compliance frame control, throughout commercial Operations, covering Pre-Sales, Ordering and Logistics
- Provide and liaise necessary training for the company staff in terms of Contract Management, Risk Management and Trade Compliance Regulations
- Provide comprehensive contract management analysis upon management need
- Develop and expand team force capability and capacity
- Continuously review contract documents and ensure that company's contractual rights are protected and to advise on same.
- Follow-up contractual requirements such as Performance Guarantees, Advance Payment Guarantees letter of credits and other such documentation.
Skill & Knowledge Requirements
- Bachelor degree or above, preferable with Legal major or profound knowledge of International trading and Commercial Operation, 10 years working experience with combination in the field of Contract Management in Sales office will be a plus.
- Fluent in English and Chinese language skills. Has comprehensive ability in effective communication at all directions
- Full and comprehensive knowledge of commercial contract management and negotiations
- Capable of working in challenged situation, self driving, integrity and with high ethical code of conduct, result-driven in the pursuing of change management
- Ability to organize workload for effective implementation and poses strong negotiation skills
