POSITION SUMMARY
This role will be responsible for providing services in connection with a wide variety of legal, regulatory, compliance, and business matters in China for the Product Identification companies. The successful applicant will need to demonstrate an ability to assess the needs of the business from a legal and regulatory perspective and work with the relevant associates of the various businesses.
ESSENTIAL DUTIES AND RESPONSIBILITIES:
? Gaining a solid understanding of the various businesses in China, their goals, and challenges and identifying appropriate legal and compliance strategies to facilitate those goals and minimize those challenges
? Being a good business partner
? Negotiating, strategizing, documenting and approving commercial transactions, contracts, and other legal arrangements including distribution, dealer, sales agency, and suppliers
? Assist with the development and implementation of policies and programs relating to anticorruption, compliant business practices and competition rules, including managing the screening, approval, monitoring and training plan for third-party sellers (distributors, integrators, OEMs, etc.) and suppliers
? Enhancing the integrity in the business and the associates’ activities, including training the associates, drafting and publishing internal rules. Working with the global compliance team to identify and mitigate compliance risks and develop appropriate countermeasures. Conduct compliance related investigations and implement action plans to remediate identified issues.
? Managing IP enforcement actions;
? Ensuring international trade compliance requirements are followed
? Providing legal support and advice relating to business model, employment, and corporate structure to different functions at different levels
? Developing appropriate approaches to dispute resolution, lawsuits, and arbitrations; providing regular, clear communication of litigation issues and opportunities to the affected business and Product Identification’s Chief Legal Counsel, China
? Assist HR colleagues with labor law support
? Assist Quality and Regulatory Affairs colleagues with regulatory law support
? Working closely with outside counsels
? Assist with mergers & acquisitions, consistent with relevant experience – from due diligence to documentation depending on the situation and background.
? Willing to work on the smallest and simplest, as well as the most complex, legal matters faced by the company

EDUCATION AND EXPERIENCE
? A law degree from a Chinese law school, preferably one recognized for graduating top lawyers. (A bachelor degree in law is a MUST and overseas higher degree in law will be an added-value.)
? Qualified to practice law in PRC China
? At least 3 years working experience in an international law firm or in a multinational company, or combination of the two
? Experience in-house preferred; some experiences that suggest an ability to hit ground running in an “start-up” function in a complex, matrixed organization is a must
? Extensive exposure to and success in a dynamic business environment
? Substantial responsibility in various areas of law and/or business
? Ability to travel domestically and internationally as needed
? Fluency in Mandarin and/or other Chinese dialect and fluency in written and spoken English required. Additional language fluency a strong plus.
? Skill of using Microsoft software (Word, PowerPoint and Excel)
