Key Job Responsibility:

-Drafting, negotiating and reviewing project-related service agreements, China-specific master agreements, purchase agreements and lease agreements with multinational and Chinese contractors and vendors. Ensuring all contracts comply with the company’s contracting policies, approvals processes and applicable laws.
-Providing legal counsel on personnel matters and ensuring compliance with Chinese labor laws. Reviewing and interpreting new labor law legislation. Supporting the Human Resources department’s management of employment contracts. Drafting, negotiating and reviewing service and lease agreements supporting expatriate staff. Interfacing with employee democratic process.
-Supporting the resolution of contract disputes, including management of local arbitration and litigation. Applying the company’s objective-based litigation technique to disputes.
-Reviewing and interpreting laws, regulations, standards and new legislation related to onshore oil and gas projects, foreign enterprises, foreign investment, and import requirements in China.


Job Requirement:
-Qualification to practice as a lawyer with a valid license to practice in China
-Fluency in spoken and written English and Chinese, with strong command of legal terminology in both languages
-Minimum five years of Chinese legal experience with an international law firm or multinational company
-Substantive understanding of Chinese contract law
-A basic understanding of international contract law and corporate internal control processes, specifically with regards to Western anti-corruption laws such as the US Foreign Corrupt Practices Act or the UK Bribery Act
-Substantial exposure to and knowledge about western legal systems (a JD or LLM from a US or UK university is desirable)
-Ability to manage a large docket of domestic and international contracts
-Attention to detail and ability to verify accuracy of both English and Chinese versions of contracts and formal correspondence
-Litigation and arbitration experience in China is desirable
-Work experience in the oil and gas, energy, or major construction industries is highly desirable
