ANTI-COUNTERFEITING OPERATIONS
CUSTOMS PROGRAM AND INVESTIGATIONS MANAGER – GREATER CHINA REGION
JOB FUNCTION: Responsible for the development, implementation and support of UL’s China Customs Program, Develops leads and conducts intelligence led investigations of high value targets. Primary objective is to successfully enforce UL’s zero tolerance policy against persons / organizations that are involved in the manufacture, distribution and/or sale of goods bearing counterfeit UL Certification Marks. Objectives are developed at the outset of the investigation and work is reviewed primarily through results obtained. Duties include intelligence gathering and analysis, investigation coordination and management, preparation of reports and recommendations for actions. The candidate will be involved in every phase of the case from initiation to resolution. Supports other ACO priorities and strategies as required.
JOB RESPONSIBILITIES:
? Leads, manages and develops UL’s China Customs Program
? Identifies and conducts analysis of intelligence, information and evidence dealing with the counterfeiting of any of the UL family of Marks.
? Provides input into overall strategies and tactics for enforcement in Greater China Region.
? Manages and directs intelligence-led investigations and enforcement actions in support of UL’s zero tolerance policy against the counterfeiting of the UL mark and the protection of the UL brand and integrity of the Mark.
? Be a liaison for China Customs and law enforcement agencies, and become involved in administrative / criminal investigations on a case-by-case basis. Work closely with external contacts including Police/Customs, legal firms and private investigators.
? Obtains adequate evidence to support criminal and/or civil actions in consultation with UL management and legal team, law enforcement and/or government prosecutors.
? Prepares investigation findings, investigative report and evidence exhibits for internal and external counsel, law enforcement and/or government prosecutors.
? Produce accurate victim statements, affidavits and necessary exhibits and documentary evidence to enable the successful prosecution of counterfeiters
? Works with PSB, AIC, TSB and Customs authorities as required – including conducting anti-counterfeiting awareness and UL Mark identification training.
? Partners with law enforcement agencies, customs officials, regulators and government agencies, industry organizations, and other rights holders to present UL’s interests and to promote UL’s zero tolerance policy against counterfeiters.
? Evaluates internal procedures and systems; makes recommendations for improvements/enhancements to UL’s Anti-Counterfeiting Program based on industry best practices and experience.
? Other duties as directed.
JOB REQUIREMENTS
? Degree holder in any discipline.
? 5+ years experience with managing IP crime investigations and projects in Greater China Region.
? Working familiarity with IP laws and regulations (criminal and civil), particularly trademark.
? Strong working knowledge of law enforcement and Customs procedures
? Substantial experience in formulating, implementing and critically reviewing investigations and enforcement initiatives.
? Strong time management, project management and workload management skills.
? Ability to multi-task, establish priorities and problem solve with a minimum supervision.
? Demonstrated ability to make sound and timely decisions
? A self-starter who works well independently as well as in a team environment
? Strong communication skills necessary to effectively work with UL staff, law enforcement, clients, and other stakeholders globally (both written and verbal).
? Fluency in English and Mandarin; Cantonese preferred (能使用粤语会是加分项目).
? Travel required.
