Purpose of the Job

This position reports to President and is responsible for advising and driving all legal & compliance matters which affect VFS. He/she supports and collabrates with business functions in pursuit of VFS objectives and values, ensuring that VFS operations comply with all the corporate policies as well as local laws.

Roles & Responsibilities

General legal issues

Provides full coverage legal support and advice for the company’s daily businesses and operations (loan and financial leasing), including providing legal advice and interpretation on business primarily related laws, legal trainings.

Drafts, reviews and negotiates agreements and other legal documents.

Maintains and manages legal documentation filing and record keeping.

Assists with APAC Regional legal work as requested.

Other corporate legal related issues, such as insurance, employment law, IT agreements, etc.

Compliance related matters

Supervises and works with Compliance Officer to manage day-to-day compliance matters to ensure adherence to regulatory requirements and Group’s policies. Advises on specific compliance issues such as data privacy and anti-money laundering.

Monitors and ensures proper regular reporting to the regulatory authorities.

Coordinates the development and implementation of company’s policies and procedures to meet regulatory and Group’s standards.

Coordinates the work with Internal Auditor to follow up on problems revealed during their audits.

Develops and maintains close and effective relationships with regulatory authorities and monitors legislative changes.

Legal affairs - collection related

Manages external law firm/collection agent network for litigation/arbitration by reviewing, evaluating and communicating with law firms/collection agents.

Monitors and follows up the progress of legal case where the company designates.

Prepares and reviews legal documents in collection matters.

Provides other legal support in collection matters including working with second-hand equipment agency in disposal of inventory, providing legal advice on collection (litigation/enforcement) process, to speed up the turnaround time.

Other legal affairs related to collection.

EXPERIENCE AND QUALIFICATIONS

Degree in Law

PRC Bar

At least 7 years’ legal experience in a law firm, a bank or a multinational company advising in the area of financial services and asset-based lending

Solid knowledge of all legal aspects, such as contract law, property law and corporate law with experience drafting commercial lending agreements such as leases, loans, inventory financing agreements, guarantees etc.

Strong commercial focus.

Strong leadership skills, sense of responsibility, good work ethics and Logical thinking.

Strong communication skill, good interpersonal and analysis skill; team player

Excellent written and spoken communication skill in both English and Mandarin.
