Job Title: Legal Counsel and Compliance Officer Greater China

Department: Legal   

Report to: Medela EVP, Greater China and to Group General Counsel

Job Purpose 

This role is responsible to provide timely and high-level professional legal and compliance service to Internal Clients to support stable and healthy business growth of Medela Greater China. He/she will be also responsible for both legal and compliance case handling and investigation, policy localization and training.

 

This role is part of Medela Greater China Leadership Core team and as such will be involved in the important decision made in the organization.

Major Accountabilities

Based on insight of organization and industry knowledge, provide professional, proactive and commercially focused legal and compliance services and solutions, including：

1) Conducting legal and compliance research and provide daily legal and compliance advice to Internal Clients;

2) Drafting or reviewing bilingual legal documents, e.g. contracts, agreements, letter of intent, letter of authorization, and company statements etc.

3) Participating in contract negotiation and establishing company's contract template pool;

4) Updating Internal Clients changes of laws / latest cases and proactively find solutions for legality;

5) Participating in Internal Client meetings and understand their needs;

6) Handling litigation /government investigation / arbitration to protect company’s legal rights and interests;

7) Managing external lawyers' service and joining commercial or operational projects as expert from legal function.

 

Executing company's comprehensive compliance program to manage legal risks, including:

1. Partnering with Internal Clients to support right tone in the team;

2. Assisting in the company’s risk assessment;

3. Implementing group guidelines and setting up and updating local guidelines / SOPs to comply with relevant local and international laws, Code of Conduct and industry code;

4. Supporting Internal Clients in their use of the company’s Document Management System;

5. Responsible for the company’s Legal Entity Management tool;

6. and delivering legal and compliance training to internal employees at various levels and 3rd parties, such as distributors and suppliers etc

Establishing, updating and optimizing company's legal and compliance service relevant process;

Part of Group's international in house lawyer team and international projects, and providing legal and compliance advice from local law perspective.

Conducting business in full compliance including but not limited to Medela Secure, Behavior in Business, Behavior in Competition, Safety, Security Health and Environmental Protection.

Background:

Education:

University degree with a master degree in law (preferably with honors) from a top ranked law school

Languages:

Proficiency in both spoken and written English confident in business discussions in English and good command of MS office software application.

Experience:

Admitted to the PRC Bar, good understanding of local foreign direct investment laws, contract law, anti-trust law, unfair competition law and other general corporate relevant laws as well as in compliance. More than 7 years’ relevant working experience in law firms and/or as “In House Counsel” in an international group of companies with preferably experience in working in foreign jurisdiction.

Travel required: Oversea (Switzerland and USA) and Greater China (Mainland, HK and TW)
