Scope, objective and relevance of position:
The Legal Counsel Data Protection holds a crucial legal position within the VCIC legal department to independently advise on all data protection related matters from a legal perspective. 

As such, the position holder is – under the supervision of and in close cooperation with the Senior Legal Counsel ICV and IT – a central contact person in charge of implementing any legal data protection related tasks assigned to the VCIC legal department. 

These tasks are assigned to the VCIC legal department to ensure that Volkswagen Group China’s ("VGC") business is carried out in compliance with applicable laws and regulations and to avoid that VGC’s business activity is adversely affected e.g. by fines, legal claims or proceedings, particularly in the area of data protection. 

This position is essential for the implementation of the Protected Customer Program (Project 2 – Legal Compliance). The position holder independently advises and drafts legal documents on all issues related to data protection in Region China, incl.: 
1.Evaluations/interpretations of laws and regulations/standards;
2.Monitoring of legal framework and requirements in Region China
3.Data protection agreements
4. Product/services development/business cooperation with third parties involving the collection/handling of personal/important data. 

Based on such evaluations/interpretations and monitoring, the position holder independently pursues to convince other employees regarding required changes to all matters relating to data protection from a legal perspectives and takes the initiate to implement these changes to the existing systems, processes and contracts throughout VGC. 

The position holder takes the initiative to communicate any legal risk in regard to data protection matters with the Senior Legal Counsel ICV and IT and other departments, as applicable. 
The position holder serves as a representative of the VCIC legal department in relevant data protection related VGC steering committees/committees (incl. Data Protection Steering Committee) as well as working groups (TRRC ICV Working Group) to facilitate decisions from a legal point of view. The position holder is also representing VCIC in relevant external working groups of industry associations (e.g. EUCCC and VDA.). 

The position holder is also required to be able to establish solid and positive relationships with other employees involved in any data protection processes across departments and to address any risk thereto from a legal perspective. In order to ensure VGC employees’ awareness of data protection matters and to create a positive attitude thereto, the Legal Counsel Data Protection provides trainings on policies and other data protection matters to other VCIC departments on a regular or as needed basis or assigns and instructs other legal staff to do so on his/her behalf. 

Range of responsibility:
This position holds the responsibility for the described legal compliance matters for the following entities, various divisions and departments: 
Volkswagen (China) Investment Co., Ltd. ("VCIC")
Volkswagen Group Import Co., Ltd. ("VGIC")
Mobility Asia Smart Technology Co., Ltd. ("MA")
Volkswagen Automatic Transmission (Dalian) Co., Ltd. ("VWATD")
Volkswagen Automatic Transmission (Tianjin) Co., Ltd. ("VWATJ")

Key Tasks:
1. Legal Counsel for legal matters related to data protection: 
 Regularly advise/instruct various departments regarding related legal issues and queries arising from their daily activities 
 Independently research and provide comprehensive analysis on all kinds of related legal issues, prepare memos and legal opinions addressing the queries and needs of the requesting departments
 Recommend, advise and facilitate actions, outline risks 
 Independently review and approve contracts for different departments (including IT, R&D, Marketing, HR etc.) from a legal perspective
 Provide legal consultation to other employees and departments, establish positive working relationship and raise awareness for captioned legal matters 
2. Representation of VCIC legal department in relevant data protection related VGC steering committees/committees (incl. Data Protection Steering Committee) as well as working groups (TRRC ICV Working Group)
     Provide advice from legal perspective,
     Recommend and facilitate actions from legal perspective
     Outline legal risks to BUs and management
3. Legal Counsel on data protection contracts
     Independently prepare, review and approve data protection contracts for different departments (including IT, HR, Marketing, R&D etc.) from a legal perspective
     Recommend, advise and facilitate actions from legal perspective
     Outline legal risks to BUs and management
4. Legal Counsel for preparation and implementation of data protection related VGC policies
    Preparation and drafting of VGC data protection policies,
    Recommend and advice actions to BU for implementation of policies from legal perspective
    Outline legal risks to BUs and management
5. Additional tasks as assigned by the supervisor due to work requests 

Qualification and skills:
Position Requirements: 
Educational Background and Professional Experience: 
- Master in law or similar legal education, preferably with study overseas 
- 6+ years professional experience in a leading law firm or a multinational company in China, preferably in the field of data protection law 
- Familiar with relevant players in Chinese Cyber Security community including Chinese officials for data protection regulations and enforcement 

Personal Skills 
Candidate shall 
- Be mature and confident, with strong interpersonal skills 
- Have the ability to work independently, under pressure with commitment to tasks 
- Give legal related instructions to other legal and non-legal staff 
- Actively align with other departments on management level through negotiations to ensure implementation of all technical/IT compliance related matters 
- Establish long-term working relationships on top management level and raise awareness for technical compliance related matters 
- Provide in-depth analysis and assessment of legal matters based on a factual approach, identify risks and independently design, apply and modify solutions based on non-standardized methods, depending on impact on company 

Remarks (Language, IT-Knowledge, Certificates etc.) 
- Excellent English and Mandarin language skills, both oral and written 
- Office software skills (Word, Excel, PowerPoint)
