Position Summary岗位概述

    

    

-         provide legal opinion in both English and Chinese independently for electronic & mechanical equipment supply/purchase contract and EPC contract and participate the contract negotiation, supervise the contract execution, provide legal opinion/solution in case of dispute with supplier/purchaser; draft any document in both English and Chinese that are needed for the contract negotiation, contract execution and dispute solution.

    

有能力以中、英文对机电设备采购/销售合同、EPC合同提供法律意见并参与谈判，独立指导合同执行，在与供应商/客户发生纠纷时有能力提供法律意见和解决方案。并负责起草合同商谈、合同执行以及纠纷解决过程中所需的各种文件。

    

    

-         Provide legal support for all kinds of leasing contract, agency or consultancy contract, issues relevant to Administration of Industry and Commerce, safety management, import & export, establishment of branch company, internal company merger (including drafting documents and providing legal opinion).

    

对公司日常运营中涉及的各类租赁、代理或顾问合同、人事纠纷、工商管理、安全管理、进出口事务、分公司设立、关联公司合并等事务提供法律支持（包括起草各类文件、提供法律意见）

    

    

-         supervise the project execution of the project managers and review all kinds of legal documents during the project execution to avoid dispute with customer, supplier. To collect documents concerned and make reaction plan in case of dispute.

    

独立指导项目经理执行项目并审核项目执行过程的各种文书，避免与客户、供应商的法律纠纷。在发生纠纷时，能够独立收集项目执行中涉及的各种证据文件、制定应对策略。

    

    

-         Manage (i) legal actions against third parties, (ii) adverse regulatory or governmental actions and (iii) defense of the company again claims made by third parties.

    

管理(i)针对第三方的诉讼, (ii)对公司不利的监管或政府行为，和(iii)应对第三方对公司提起的索赔。

    

    

-         Provide legal support for the sales, purchase activities of other Andritz Group entities in global.

    

为安德里茨集团全球关联公司在华的销售、采购活动提供法律支持。

    

    

-         Provide support to merger and acquisition activity in China as needed.

    

为在中国实施的合并购提供支持

    

    

-         Provide Chinese, English translation of legal documents.

-         - Keeps the business team informed on legislation and regulations and other important legal matters both local and global and any legal developments that could impact the company’s business.

Competence

    

任职资格

    

1.      3  years working experience as in-house counsel in mechanical industry or as litigation attorney in law firm.

    

3年左右机械制造行业/建设工程行业公司律师或执业诉讼律师工作经验。

    

    

2.      Possesses a post-graduate law degree

    

法律/法学硕士

    

    

3.      Bar admission in PRC and/or other jurisdictions

    

在中国境内通过司法考试或获得其他司法管辖区的律师认证

    

    

4.      Be able to communicate in English and draft legal document in English

    

熟练运用英文与各国同事进行工作交流，有能力以英文起草法律文件

    

    

5.      Very good knowledge of Chinese laws relevant to mechanical, electrical business and construction business

    

熟悉机电工程领域、建设工程行业法规

    

    

6.      Knowledge of western legal analysis and paradigms are required.

7.      Be strong at logical analysis; be able to analyze the problem and provide solutions.
